The rules of the road for using getloyally.com and the Loyally services, including the specific terms that govern our SMS messaging program.
These Terms of Use (the “Terms”) are a binding agreement between you and Loyally LLC, a Virginia limited liability company based in Charlottesville, Virginia (“Loyally,” “we,” “our,” or “us”). They govern your access to and use of getloyally.com and any Loyally products, services, and software we offer (collectively, the “Services”). By accessing the Services, booking a growth call, opting in to receive SMS messages, or otherwise interacting with Loyally, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Loyally is a growth and retention system for pet care businesses. It captures inquiries, automates follow-up, generates reviews, recovers no-shows, and reactivates lapsed clients on behalf of facilities that subscribe to a Loyally plan. Loyally complements (and does not replace) booking software such as Gingr, MoeGo, PetExec, or Kennel Connection.
You must be at least 18 years old and legally able to enter into a contract to use the Services. If you are using the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms, and that “you” in these Terms refers to that business as well.
These SMS terms apply whenever you provide a mobile number to Loyally and consent to receive text messages from us, whether through the booking form on this website, a separate sign-up flow, or any other Loyally channel.
When you opt in, Loyally may send you transactional and informational text messages, including (without limitation): growth-call confirmations and reminders, account notifications, replies to inquiries you’ve submitted, onboarding updates, and occasional service announcements. Some clients use Loyally to send messages to their own pet-parent contacts; those messages are sent by the client (the business that operates the facility) and are governed by the agreement between you and that client, not by these Terms.
Message frequency varies based on your interactions with us. You should expect a small number of messages per week on average; specific volumes depend on the workflows you have opted in to.
Message and data rates may apply. Your wireless carrier may charge you for sending or receiving text messages according to your service plan. Loyally is not responsible for these charges.
Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, Google Voice, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile phone numbers and text-messaging opt-in data and consent are excluded from any data sharing described in our Privacy Policy. We use messaging providers (including HighLevel / LeadConnector and Twilio) only to deliver the messages you have opted in to receive.
Some Services require an account. You agree to provide accurate, current, and complete information when you register, to keep it up to date, and to keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly at support@getloyally.com if you suspect unauthorized use.

The Services, including all software, design, text, graphics, logos, and trademarks (such as “Loyally” and the Loyally mark), are owned by Loyally LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your internal business purposes, subject to these Terms. All rights not expressly granted are reserved.
If you submit feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
The Services rely on third-party providers (including HighLevel / LeadConnector, Twilio, Vercel, Google, and Meta) and may interoperate with software you already use (such as Gingr, MoeGo, PetExec, or Kennel Connection). Your use of those third-party services is governed by their own terms, and Loyally is not responsible for their performance or content. We are not liable for any third-party act, omission, or failure.
If you subscribe to a paid Loyally plan, fees and billing terms are described in the order form, plan listing, or invoice you receive at the time of purchase. Unless stated otherwise, fees are billed in advance and are non-refundable. Where a Loyally plan includes managed advertising, ad budgets are billed directly by Google and Meta to your own ad accounts and never pass through Loyally; we do not mark up ad spend. Any one-time setup fees are described at the time of purchase and are non-refundable once setup has begun.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE ANY SPECIFIC BUSINESS OUTCOME, INCLUDING LEAD VOLUME, BOOKING RATES, OR REVENUE LIFT, FROM YOUR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, LOYALLY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID LOYALLY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Loyally and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, your content, your use of any messaging program in violation of applicable law or carrier rules, or your violation of any third-party right.
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if we are required to do so by law, or for any other reason in our reasonable discretion (for example, to protect the security or integrity of the Services). Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Subject to the next paragraph, any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Charlottesville, Virginia, and each party consents to personal jurisdiction in those courts.
You and Loyally agree to first attempt to resolve any dispute informally by contacting support@getloyally.com. If the dispute is not resolved within 30 days, either party may pursue formal proceedings as described above.
We may update these Terms from time to time. When we make material changes, we will revise the “Effective date” at the top of this page and, where appropriate, give you additional notice (for example, by email or a notice on the Services). Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
